The responsibility of CHICAGO HAJJ & UMRAH,
as the tour operator and their agents are limited CHICAGO HAJJ
& UMRAH, located at 2818 W Peterson Ave Chicago IL 60659, acts only as agents for the pilgrims in making arrangements for the airlines,
hotels, buses or any other services in connection with the performance of their
Hajj and Umrah and assumes no liability whatsoever for injury, damage, loss, accident,
delay or irregularity which may be occasioned either because of a defect, through
the acts or defaults of any company or person engaged in conveying pilgrims or in
carrying out the arrangements of the tour, or as a direct or indirect result of
acts of GOD, dangerous incidents in the air, sea, land, fire, breakdown of machinery
of equipment, acts of governments or other authorities de jurs or de facto, wars,
whether declared or not, hostilities, civil disturbances, strikes, riots, theft,
pilferage, epidemics, quarantines, medical or customs regulations or from any loss
or damage resulting from improper passport, visas or other documents.
CHICAGO HAJJ & UMRAH will accept no responsibility
for loss or additional expense due to delay or changes in schedule or other causes.
CHICAGO HAJJ & UMRAH shall not be liable or responsible for any inconvenience, loss, damage or injury arising in connections with such services. CHICAGO HAJJ & UMRAH shall not be responsible for the failure
to follow instructions including but not limited to check-ins and delays. It is
the responsibility of the airline to determine exactly what procedure will be followed.
The policy chosen by that carrier shall be based on their procedure and shall not
be the responsibility of CHICAGO HAJJ & UMRAH and its affiliates. They will
also not be responsible for any person (s) missing and part of the program due to
his negligence or delay or absenteeism for any time during the tour and will not
be responsible for any additional expenses for the participant to rejoin the tour.
Moreover no changes or upgrading in the chosen program will be honored after departure
as well as no refund will be given for any services rendered unutilized..
Reservation / Deposits: A deposit of $2,000 is
required for reservation. Full payment is required 90 days prior to departure.
Maulim Draft/ Hajj fee: are additional and not included
in any package/ programs also there are some optional fee/ charges please call CHU
for details.
Cancellation: All cancellations must be in writing.
Cancellation from registration date till 90 days prior to departure will be subject
to $1000/ person, from 85 – 40 day prior to departure will be $1500.00/ person.
Any cancellation received less than 45 days from departure date is non-refundable.
Document Processing & Handling: Chicago Hajj
& Umrah Group is a private company. We are not associated with any US or foreign
government offices or Embassies. We are not responsible for the granting or denying
of documents. We are not responsible for the delay or damage of documents due to
any consulate or another government office. We will use DHL or FedEx to return your
documents unless you send us a completely filled out label on the carrier of your
choice to use for the return. We are not responsible for any delays or damages due
to Federal Express or any other delivery service. We are not responsible for delays
or damage due to natural disaster, building maintenance failure, city infrastructure
failure or any other acts that are reasonably beyond the control of Chicago Hajj
& Umrah Group...
HANDLING OF DISPUTES.
A. Arbitration of disputes. Notice: You are agreeing to have any disputes related to the contract for travel/hajj
the pilgrimage included in this “arbitration of disputes” provision decided
by neutral arbitration, as provided by Illinois law, and you are giving up any rights
you might possess to have the dispute litigated in a court or jury trial. You are giving up your judicial right to discovery and appeal,
unless those rights are specifically included in the “arbitration of disputes”
provision, you may be compelled to arbitrate under the authority of Illinois
code of civil procedure, your agreement to this arbitration provision is voluntary.
Arbitration under this provision shall occur under the american arbitration association’s commercial rules of arbitration and shall be limited to those disputes related solely
to the contract for travel/hajj pilgrimage. We have read and understood the foregoing
and agree to submit disputes arising out of the matters included in the “arbitration
of disputes” provision to neutral arbitration.
B. ATTORNEYS’S FEES. If either
party hereto fails to perform any of its obligations under this Agreement or if
any dispute arises between the parties hereto concerning the meaning or interpretation
of any provision of this Agreement, then the defaulting party or the party not substantially
prevailing in such dispute, as this case may be, shall pay any and all costs and
expenses incurred by the other party on account of such default or in enforcing
or establishing its right hereunder including without limitation, court costs and
reasonable attorney’s fees and disbursements. Any such attorney’s fees
and other expenses incurred by either party in enforcing a judgment in its favor
under this agreement shall be recoverable separately from and in addition to any
other amount included in such judgment and such attorney’s fee obligation
is intended to be severable from the other provisions of this Agreement to survive
and not be merged into such judgment.
C. GOVERNING LAW AND AVENUE. This
The agreement is governed by the laws of the State of Illinois. The parties agree that
the exclusive venue for any disputes, arbitration or litigation concerning this
contract, its alleged breach or its enforcement, shall be in the county in which
the Property is located. Both parties agree to irrevocably waive their respective
rights to a jury trial of any cause of action, claim, counterclaim, or cross-complaint
in any action or proceeding and/or hearing brought by either party against the other
on any matter whatsoever arising out of this Agreement.
D. Both parties agree that Chicago Hajj & Umrah does not assume any responsibility for handling your passports/packages. You hereby agree to indemnify
and hold Chicago Hajj & Umrah harmless against any cause of action, lawsuit
, or other liability that arises from their delivery of your documents to the preferred
third party services of FEDEX , DHL , UPS and USPS couriers. Any issues relating
to the delivery of packages/passport should be addressed with these respective agencies.

CONDITIONS AND AGREE WITH ALL TERMS AND CONDITIONS. ALSO FULLY UNDERSTAND THE PACKAGE
